The key 2024–2026 milestones you need to know:
- January 1, 2024: Tier 0 and Tier 1 engines phased out completely. No California fleet can operate them under any circumstances.
- January 1, 2025: Tier 2 and Tier 3 engines manufactured before 2009 are prohibited from operation in California unless designated low-use (under 1,000 hours/year) or emergency-use.
- Public works projects: Prime contractors must obtain and retain Certificates of Reported Compliance for all equipment — yours and your subcontractors' — for three years after project completion.
- Idling restrictions: All diesel equipment must limit unnecessary idling to five minutes maximum. Large and medium fleet owners must have written idling policies.
- Renewable diesel documentation: Fleet owners renting equipment in California must maintain records of renewable diesel fuel procurement for three calendar years.

Under CARB's contracting requirements, prime contractors on public works projects are required to obtain and keep copies of valid Certificates of Reported Compliance for all equipment operating on their projects — including rented and subcontractor-supplied equipment. If CARB shows up on your jobsite and a subcontractor is running a pre-2009 Tier 2 excavator, you may be on the hook for enforcement action. Always verify compliance documentation before any rented machine touches your site.
How to Check If Your Rental Equipment Is Compliant

- What is the engine tier and model year? Any Tier 4 Final or Tier 4 Interim engine manufactured after 2012 is compliant. Pre-2009 Tier 2/3 engines are not unless specifically exempted.
- Is the rental company registered in CARB's DOORS system? All California off-road diesel fleet operators must report their fleet inventory annually through CARB's Diesel Off-Road Online Reporting System (DOORS). Ask for their fleet registration confirmation.
- Can they provide a Certificate of Reported Compliance? Legitimate California rental companies operating CARB-compliant fleets can produce this documentation. If they hesitate, that's a red flag.
- Does the machine have a visible emission control label? Tier 4 Final engines carry EPA and CARB certification labels showing their emissions tier. Check it before the machine starts working.
